                                                  Pet Grooming Services Agreement

         

This Pet Grooming Services Agreement (the "Pet Grooming Agreement") governs the provision of grooming services delivered by Cimma Wellness Inc. doing business as Pupper Palace, a company incorporated under the laws of British Columbia, with offices at 4255 Fraser Street, Vancouver, BC V5V 4G1, Canada  ("Pupper Palace" or "Us") to pet owners ("Pet Owners", the "Client" or "You"), in connection with their pets. 


The term “grooming services” herein includes all types of services we provide to Pet Owners regarding their pets, including, among others, pet washing, dog grooming, nail trimming and any other services you may book with us, or we may provide to you in our shop (the "Grooming Services" or the "Services").


If you book Services with us or bring your pet to our salon for us to provide Services, you acknowledge that you have read and understood the terms and conditions contained herein and that you agree to be bound by this Pet Grooming Agreement, including our Cancellation Policy. PLEASE TAKE A MINUTE TO READ CAREFULLY THESE TERMS AND CONDITIONS.


1. Services

We offer a range of pet grooming services including bathing, brushing, nail trimming, ear cleaning, and haircuts. Our Services are listed on our website and in other digital domains and may change or be updated from time to time. The specific Services you request will be outlined in the appointment confirmation email that you will receive after booking (the “Appointment Confirmation”).  The  full description of each service or offering, is available in our website. If you request certain other specific services to our pet groomers and they agree to provide you such services, those additional services will be considered as part of the Services and you will agree to pay for such services as well. 


2. Appointments. 

Appointments must be scheduled in advance. We recommend booking at least 3 days ahead. You will be requested to provide certain information in order to complete your appointment, including your contact details (name, email and phone number)for purposes of customer identification and your credit card information.  The collection and processing of this information is subject to our Privacy Policy and our Cancellation Policy, set forth herein. 


For booking, you agree to provide complete, truthful, and accurate information regarding your pet prior to any grooming services. This includes, but is not limited to, details concerning the pet’s:


a) Health conditions (including chronic illnesses, allergies, or recent surgeries)

b) Temperament, character, and behavioral tendencies (e.g., aggression, anxiety, fearfulness)

c) Geriatric or age-related conditions

d) Size, age, and weight

e) Hair conditions 


You acknowledge and agree that such information is essential for the safe and effective provision of the Grooming Services.  Failure to disclose relevant information may result in refusal of service, additional charges, or liability for any damages or injuries caused during the grooming process to us or to third parties. 


3.  Payment Terms
Payment is due at the time of Service. You acknowledge and agree that fees set out in our website and in your confirmation, email are initial or estimated fees based on the information that you provided when booking.You acknowledge and agree that additional charges may apply as set forth in this Agreement,  and you gree to pay for all such amounts.  Additional charges will be informed to you, when applicable, upon completition of the Service  (including in cases where the Service is suspended or terminated early, as set out hereunder).  


4.  Cancellation Policy. Cancellations  must be received by us at least 48 hours before the beginning or your appointment time, which  is set out in the Appointment Confirmation message. Otherwise, you may be charged a cancellation or no-show fee (the "No-show fee"). The No-show fee will be an amount equivalent  to 50% of the value of the Service booked, unless stated otherwise by us in writing.  


5. Health and Safety Representations and Obligations for Pet Owners

a) Vaccinations: Your pet shall be fully vaccinated. You shall not bring your pet if your pet is not current with mandatory vaccinations. By bringing your pet to the grooming session, you declare and warrant that your pet is up to date on all veterinary prescribed vaccinations, including but not limited to rabies, DHPP, and Bordetella.

b) Aggressive or Reactive Pets: Please inform us when making your appointment if your pet could be considered aggressive or reactive. Likewise, you shall let us know if your pet may bite or has ever bitten any person or other animal.

c) Medical Conditions: You shall fully advise us of any allergies, sensitivities, or pre-existing medical conditions regarding your pet, so we can avoid aggravating these situations by providing the services.

d) Previous Grooming Experiences: Please let us know of any prior grooming history you or your dog may not have found satisfactory. We consider that pets have the ability to experience emotional states such as pleasure and pain. We want to avoid the repetition of poor or unpleasant experiences or situations.

e) Geriatric Pets: We will use extra care and patience for older pets; however, Client accepts to hold harmless Pupper Palace and any of its directors, shareholders, employees, or contractors, for any reaction suffered by a pet due to the mental or physical stress of grooming geriatric pets, including damages and or death of the pet, regardless of the cause or the injury or death of the pet.   If in our judgment, brushing or clipping is determined to cause too much stress to the pet, we will modify or terminate services, and client shall pay the full charge of the session. Please be sure to notify us of any health conditions that might make your pet uncomfortable during the bathing, drying, or clipping phases. You acknolwedge and agree that any grooming which takes place on an elderly or frail pet is conducted at your risk, including risk of injury and risk of death, even in cases where our staff should have been aware of the possibility of the such risks to occur or materialize. 

f) Don’t Allow Your Pet to See You: If you arrive early to pick up your pet and they are still being groomed, please do not talk to them or allow them to see you! An excited pet can be dangerous to work on. For the pet to properly respond to the groom, it is essential the pet be alone with the groomer; clients shall not assist in the grooming unless requested to do so.

g) Products: Our staff is aware that products not labeled for use on animals can only be used for grooming by instruction and  authorization of Pet Owner (verbal authorization will suffice).

h) Emergency protocol: In case of an perceived emergency involving your pet, other pets, our staff or third parties you authorize us to take your pet to veterinary services, boarding or care-taking, among other actions. You agree to pay to us the corresponding fees and costs, including transportation costs,  if applicable.  Groomers may, at their discretion, consider emergencies pet health conditions involving advanced age, extreme nervousness, neurosis, illness, previous injury, skin or coat conditions, fleas, or other medical conditions.

i) Fleas: If fleas are found on your pet, the groomer/stylist will administer a flea bath aimed to eradicate the fleas in order to maintain salon sanitation. This is at the groomer/stylist's discretion and at the client's expense.  We cannote ensure fleas to be completely erradicated. The shampoo will be gentle, non-alkaline, and hypoallergenic. You agree to pay for any damages or costs caused to us or to third parties if you bring your pet with fleas to our salon. 

j) Mats and Shave Downs: Mats can be very difficult to remove and your pet may receive a "shave down" to remove them. At groomer discretion, under this circumstance, a shave down is the only way to allow the skin to receive necessary oxygen and for new, healthy hair to grow. Charges for the shave down (or shaving ears and tail if they are matted) are determined on a per pet basis. Client is aware that if the client requests the mats to be combed out, the groomer/stylist may refuse to do so if it causes the pet undue stress or pain. Excessive de-matting is a painful, time-consuming, and costly procedure that causes extreme discomfort and can aggravate (or cause) skin problems. Client recognizes that refusal by client to shave down pet’s coat can cause problems after grooming/shave down such as clipper/brush irritation, itchiness, failure of hair to re-grow, and make pet prone to sunburn.

k) Shave Downs or Custom Cuts: Shave downs or custom cuts that are outside normal specific breed haircuts will be discussed between clients and groomers before the service; groomer/stylist will perform the cuts to the best of their understanding of the client's directions and their ability but no other guarantee is made of the final work product.

l) Session Extensions and Additional Costs: Every effort will be made to keep our scheduled grooms running smoothly. If your pet has behavior issues or skin and coat problems, grooming sessions may be extended and Client may be charged with additional Services fees.

m) Groomer's Professional Discretion to Modify or Abort a Session: We reserve the right to alter or cease any groom in the event that our staff determines it is in your pet's best interest, or if your pet displays aggressive behavior that may create risks for other clients, employees, or animals. Client understands that we have the right to refuse service to the client’s pet at any time for any reason, as decided exclusively by our staff.


6. Grooming Products
We use a variety of grooming products to ensure the care for your pet. These products include shampoos, conditioners, detanglers, and other grooming aids specifically formulated for pets.

If your pet has any known allergies or sensitivities, please inform us in advance so we can choose appropriate products. If you prefer specific grooming products to be used on your pet, please provide them at the time of your appointment. We will use them as per your instructions. 


7. Warranty.

 All grooming services provided by Pupper Palace are offered “as is” and without any warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability,
  • Fitness for a particular purpose, and
  • Non-infringement.

We do not guarantee any specific results from our grooming services, and we make no warranties regarding the condition, behavior, or health of your pet following grooming. You acknowledge and agree that grooming involves inherent risks, and outcomes may vary depending on the pet’s coat, age,  temperament, and health. Nothing in this disclaimer shall limit any rights you may have under consumer protection laws in British Columbia that cannot be waived.

8. Accidents.

You acknowledge that you understand that, despite the level of expertise of a groomer, a pet may not comply with instructions or fail to stay still during the grooming process. Accidents may include nicks from clippers, scissors, or toenail trimmers.


9. Use of Muzzles and Other Devices

You acknowledge that we may occasionally be forced to employ muzzles, elastic collars, slings, or straps over the pets. However, we will only use such items when necessary, as considered by the groomer, and with the intention to protect the safety of your pet and the groomer.


10. Early Termination of Services: We reserve the right to end the grooming session even if the groom has not been completed yet, if the groomer decides that grooming should be stopped in order to protect the security and safety of the groomer, your pet, third parties or other pets. The Client understands that agrees that  dogs are extremely sensitive to certain grooming procedures such as nail trimming and/or ear cleaning. It is not our intent to cause your dog discomfort. Although these are routine procedures normally performed for the well-being of the pet, we will not continue with any grooming procedure that will cause substantial pain or discomfort to the pet or harm to the groomer/stylist. Sometimes for a more sensitive dog, these procedures are best left to the care of a veterinarian. You agree that you will pay for the full grooming fees even if the service was not concluded because the groomer decided that service should be aborted in benefit of the pet, the groomer, or both.


11. Limitation of Liability.  

 To the fullest extent permitted by applicable law, Pupper Palace, including Cimma Wellness Inc. its Directors, shareholders, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for: (a) any loss of profits, revenue, data, or use, arising out of or related the grooming services provided, even if advised of the possibility of such damages and/or; (b) any injury, illness or death of a pet ocurring during  or after the provision of grooming services, even if advised of the possibility of such injury, illness or death of the pet, except where such harm, illness or death is the direct result of gross negligence or willful misconduct. 


You acknowledge and accept that Grooming Services involve inherent risks, particularly for pets that are elderly, aggressive, anxious, or have pre-existing health conditions. While we take reasonable precautions to ensure the safety and well-being of every pet in our care, we cannot guarantee the outcome of grooming procedures. 


You acknowledge and agree that In no event shall Pupper Palace’s (including Cimma Wellness Inc. its Directors, shareholders, employees, agents, and contractors) total liability  for any claim arising out of or relating to the services exceed either: (a) the estimated fee set out in the Appointment Confirmation or,  (b) the fee paid by the Client,  in connection with the specific grooming service giving rise to the claim.


This limitation of liability applies regardless of the cause of action, whether in contract, tort (including negligence), strict liability, or otherwise, and survives the termination or expiration of any agreement.


Nothing in this clause shall limit any rights or remedies available to consumers under the laws of British Columbia that cannot be excluded or waived.


12.  Indemnity: Client shall indemnify and hold harmless Pupper Palace, including its directors, officers, members, shareholders, insurers,  agents, customers, employees, contractors, servants, and assigns (collectively, the “Indemnitees”) from and against: (a) any or all liabilities, claims, actions, suits, costs (including legal and attorney fees), damages, actions, and other proceedings made, sustained, brought, or prosecuted in any manner based upon, occasioned by, or attributable to the behavior or health of the pet, including from any known or unknown pre-existing condition of the pet; (b) all loss, damage, or liability of any kind whatsoever, for injury to or death of persons whomsoever (including customers, shareholders, directors, or employees of Pupper Palace) and for damage to, loss of, or destruction of property (including other pets) arising in any way, or attributable to the behavior or health of the pet, including from any known or unknown pre-existing condition of the pet.


13.  Privacy Policy
We respect your privacy and will not share your personal information with third parties without your consent. For more details, please refer to our Privacy Policy, available in our website. 


14. Changes to Terms and Conditions
Pupper Palace reserves the right to update these Pet Grooming Agreement at any time.  Changes will be posted on our website.


15. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of British Columbia, Canada. Any disputes arising from these terms will be subject to the jurisdiction of the courts of British Columbia.
